Articles of Association

 

WHEREAS, the property owners on Port Duncan of Monkey Island, Phases I, II and III, and owners of unplatted land and unit ownership estates, desire to more fully have their mutual rights and obligations set forth and defined; and

WHEREAS, said owners do desire to create an association of owners for the mutual benefit of all owners participating in said association;

THEREFORE, BE IT RESOLVED, STIPULATED AND AGREED as follows:

1. Port Duncan Owner's Association is hereby created and record title owners of real property in Port Duncan of Monkey Island, Phase I, II, III, certain unplatted land and unit ownership estates who execute an acknowledgement and consent to these "Articles of Association" shall be members thereof as shall be their successors and assigns, and these "Articles of Association" shall have the force and effect of covenants running with the land.
2. Port Duncan Owner's Association shall have all the power authorized by the Statutes of the State of Oklahoma now in existence or which may hereinafter be adopted including the enforcement of restrictive covenants covering the real property encompassed within the Association.
3. The rights, obligations, liability and restrictions and rules governing the Port Duncan Owner's Association shall be as set forth in the By-Laws attached hereto as Exhibit A and incorporated herein by reference as if set out verbatim.
